Filter items still showing up after unpublished

I have a component built for Joomla 3+ that has five filters on the front and backend.  The component is working as expected with one exception.  If an item is unpublished or trashed it's still showing up in the filters and in the view.  Also, the order of the items is not how I've ordered them in the backend.  The ordering in the backend does nothing in the frontend.

See attached screenshot for example.  The Innovate 2013 has been unpublished, but is still showing up.

Can someone point me in this right direction?
